Welcome to CarVital AI. By accessing or using our platform at carvital.ai, our mobile applications on the Apple App Store and Google Play, or any related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
1. Description of Service
CarVital AI provides AI-powered car health diagnostics, maintenance recommendations, car profiles, a routine checklist, public user profiles, a community feed, friendships, direct messaging, and a walkie-talkie voice feature between users. Our Service uses artificial intelligence to analyze vehicle data and provide recommendations. The Service is provided "as is" and is intended for informational purposes only.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 13 years old to create an account, or 16 in jurisdictions where that is the applicable minimum age (including the European Union).
- One person may not maintain more than one account.
- You are responsible for all activity that occurs under your account.
- You may delete your account at any time from Settings → Account → Delete Account.
3. Subscriptions and Payments
- Basic Plan: Free tier with limited features (1 car, 5 diagnostics per month).
- Pro Plan: Paid subscription that unlocks:
- Up to 100 cars in your garage
- 500 AI diagnostics per month
- AI chat with your car (model-specific assistant)
- Detailed AI car profiles with model-specific specs and known issues
- Maintenance recommendations with cost estimates and service locations
- Routine checklist tracking
- Maintenance reminder emails on your chosen schedule
- Walkie-talkie voice calls with other Pro members
- Pro badge on your public profile and community posts
- Priority support
- Web purchases: Processed securely through Stripe. By subscribing on the web, you agree to Stripe's terms of service.
- In-app purchases: Subscriptions purchased through our iOS app are processed by Apple via the App Store, and subscriptions purchased through our Android app are processed by Google via Google Play. Those purchases are governed by the respective store's terms.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period (monthly or annual, depending on the plan you selected) at the then-current price, unless cancelled at least 24 hours before the renewal date.
- Cancellation (web): Cancel anytime from Settings → Account, which opens the Stripe Billing Portal. Cancellation takes effect at the end of the current billing period.
- Cancellation (iOS): Manage or cancel from Settings → [your name] → Subscriptions on your Apple device. Refunds are handled by Apple.
- Cancellation (Android): Manage or cancel from the Google Play app under Subscriptions. Refunds are handled by Google.
- Refunds (web): Handled on a case-by-case basis. Contact us for refund requests.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated tools, bots, or scrapers to access the Service without our permission
- Upload malicious content, viruses, or harmful code
- Harass, abuse, threaten, or harm other users through the community feed, comments, direct messages, or walkie-talkie calls
- Send unsolicited promotional content (spam) via direct messages, voice calls, or community posts
- Post or send sexually explicit, hateful, violent, or otherwise inappropriate content, images, or audio
- Attempt to intercept, record without consent, or otherwise tamper with another user's walkie-talkie audio
- Impersonate another person or misrepresent your affiliation with any person or entity
- Post false, misleading, or inappropriate content in the community
- Resell, redistribute, or commercially exploit the Service without authorization
- Abuse API endpoints or intentionally overload the Service
- Bypass usage limits, gate logic, or any rate-limiting mechanism
5. AI-Generated Content Disclaimer
Important: Please read this section carefully.
- All diagnostics, recommendations, cost estimates, and car profiles are generated by artificial intelligence and are for informational purposes only.
- AI-generated content is not a substitute for professional mechanical inspection, diagnosis, or advice.
- Cost estimates are approximate and may vary based on location, service provider, and market conditions.
- Always consult a qualified mechanic or authorized service center before making decisions about your vehicle's maintenance or repairs.
- We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
- CarVital AI is not liable for any damage, loss, or expense arising from reliance on AI-generated recommendations.
6. Community Guidelines
- Be respectful to other community members.
- Do not post offensive, harmful, or inappropriate content.
- Do not share personal information of others without their consent.
- We reserve the right to remove any content that violates these guidelines.
- We may suspend or terminate accounts that repeatedly violate community guidelines.
6a. Direct Messages
- Direct messages are a private channel between two users, but they are not end-to-end encrypted and are stored on our servers so they can be delivered.
- You are responsible for the content of any message or image you send via DMs.
- We may review reported messages to investigate Terms violations or comply with the law.
- Do not use DMs to send spam, scams, malware, illegal content, or harassment. Doing so may result in suspension or termination.
- You can block users and report abusive messages from within the app.
6b. Public Profiles & Privacy Controls
- Each account has a public profile page at /u/your-username that may be viewable by anyone on the internet, including search engines.
- Your username, display name, avatar, bio, and community posts are public by default.
- From Settings → Privacy you can control whether you appear in Discover, in "People to Meet" suggestions, and whether your cars are displayed on your public profile.
- Even with these toggles off, signed-in users you interact with directly (e.g. via DM or friendship) will still see your profile.
6c. Walkie Talkie Voice Calls
- The walkie-talkie feature streams live audio peer-to-peer between Pro users using WebRTC. We do not record calls.
- Both participants must be Pro subscribers to talk. Joining a room without a Pro subscription is blocked.
- Do not record, transcribe, or rebroadcast another user's audio without their explicit consent. Doing so may violate wiretap and recording laws in your jurisdiction.
- Do not use the feature to harass, threaten, or impersonate others. Reports of abuse may be investigated using metadata (call times, participants), and accounts may be suspended.
- Due to the peer-to-peer nature of WebRTC, your IP address is exposed to the other participant during the call. By starting or joining a call, you consent to this disclosure.
- If you are auto-disconnected after sitting alone in a room for two minutes, the room is closed and presence rows deleted.
7. Intellectual Property
The Service, including its design, features, code, and content (excluding user-generated content), is owned by CarVital AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.
8. User Content
- You retain ownership of content you create (community posts, comments, images, direct messages, car notes, etc.).
- By posting content publicly, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it within the Service.
- For direct messages and walkie-talkie audio, the license is limited to what is necessary to deliver, store, and display the content to the intended recipient.
- You are responsible for ensuring you have the right to share any content you post or send.
- We may remove user content at our discretion if it violates these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, CarVital AI and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or vehicle damage, arising out of or related to your use of the Service. Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
10. Termination & Account Deletion
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
You may delete your account at any time from Settings → Account → Delete Account. Deletion permanently removes your profile, cars, diagnostics, posts, comments, friendships, direct messages, and routine logs from our active database within 30 days. Some information may be retained for longer where required by law (e.g. billing records for tax purposes) or in encrypted backups for a short additional period.
11. Mobile Application Terms
Apple App Store users:
- These Terms are between you and CarVital AI only, not with Apple. Apple is not responsible for the app or its content.
- The license granted to you for the iOS app is limited to a non-transferable license to use the app on any Apple-branded products you own or control, as permitted by the App Store Terms.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the app, including product-liability claims and intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play users:
- These Terms are between you and CarVital AI only, not with Google. Google is not responsible for the app or its content.
- Use of the Android app is also subject to the Google Play Terms of Service.
- Google has no obligation to provide support or maintenance for the app.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes via email, an in-app notice, or a notice on the platform. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of Malaysia, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Kuala Lumpur, Malaysia, except where applicable consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts. Nothing in these Terms limits your statutory consumer rights.
